# In-House Counsel Insurance Recovery Mortgage Disputes **Evertrust Development Group Inc.** · Markham, ON · `On-site` 🕒 **Статус:** *Опубликовано: 3 дня назад* · *Источник: Indeed* --- ### About the Role About the Role Evertrust Development Group Canada Inc. is looking for an Ontario-licensed lawyer to join its in-house legal team and take an active role in complex insurance, mortgage, real estate, construction and commercial disputes. A major focus of this position will be insurance recovery on behalf of the insured/policyholder, particularly claims connected with construction and real estate development projects. The successful candidate should be comfortable reviewing insurance coverage, developing claim strategy, preparing supporting materials, negotiating with insurers and moving disputed claims toward resolution. The role will also involve significant mortgage and lending litigation, including enforcement proceedings, power of sale matters, receiverships and disputes concerning secured lending. We are looking for someone who can independently manage active files, identify practical legal solutions and communicate clearly with management, insurers, lenders, external counsel and other professionals. Your Responsibilities · Take carriage of insurance claims and coverage disputes arising from construction, property and development losses. · Review insurance policies and advise on coverage, exclusions, indemnity, recovery options and claim strategy. · Prepare and advance claims involving Builder’s Risk, Course of Construction, commercial property insurance, CGL, business interruption, Delay in Opening and delayed-completion losses. · Assess loss components such as hard construction costs, soft costs, lost rental income, restoration expenses, expediting costs, professional fees and other recoverable or uninsured amounts. · Prepare claim submissions, coverage correspondence, demand letters and supporting evidence for insurers and other stakeholders. · Negotiate directly with insurers, adjusters, brokers, coverage counsel and experts regarding coverage, quantum and settlement. · Advise on denied or restricted coverage, reservation-of-rights positions, policy interpretation issues and potential claims involving insurer or broker conduct. · Manage mortgage and lending disputes involving mortgage enforcement, power of sale, receivership, priorities, realization of security, guarantees, lender/borrower disputes and mortgage accounting. · Draft pleadings, affidavits, motion records, application materials, factums, settlement offers, releases and other litigation documents. · Attend or support discoveries, mediations, motions, hearings, settlement conferences and other Ontario court proceedings. · Assess litigation risk, available evidence, damages, recovery prospects, limitation periods and procedural requirements. · Coordinate external counsel, insurers, lenders, accountants, engineers, consultants, adjusters and other experts. · Work with management, accounting and project teams to gather records and build clear factual, financial and evidentiary support for claims and litigation. · Assist with related construction lien, contractual, condominium, purchaser-default, debt-recovery and commercial disputes as required. · Maintain control of multiple active matters and ensure deadlines, undertakings and next steps are followed through promptly. Qualifications · LL.B. or J.D. from a recognized law school. · Member in good standing with the Law Society of Ontario. · At least 3 years of Ontario civil litigation experience. · Meaningful experience with insurance claims and insurance coverage disputes, preferably representing insureds or policyholders rather than practising exclusively in defence-side liability matters. · Meaningful experience with mortgage, secured-lending or lender/borrower litigation. · Practical knowledge of the Ontario Rules of Civil Procedure. · Experience drafting litigation materials and managing contested proceedings. · Strong legal research, drafting, advocacy and negotiation abilities. · Ability to analyze complex insurance policies, contracts, financial records, project documents and evidentiary materials. · Strong organizational skills and the ability to independently manage several active matters and competing deadlines. · Commercial judgment and the ability to explain legal risks and options clearly to business decision-makers. · Ability to work collaboratively with management, external counsel and other internal and external stakeholders. Experience working with a real estate developer, construction company, lender or other commercial organization is also considered an asset. What This Position Offers This is an in-house position with direct exposure to active construction, development, insurance and financing disputes. The successful candidate will work closely with senior management and will have the opportunity to influence claim strategy and litigation decisions rather than performing only isolated legal tasks. The position is suited to a lawyer who is practical, responsive, commercially minded and comfortable taking ownership of complex matters from initial assessment through negotiation, litigation or resolution.
